CONTRACTUAL TERMS AND CONDITIONS FOR COMPANIES

1. Preamble
THE Mirantes Technologies - Prestação de Serviços, Lda. owns the platform Viewpoints. In its mission to connect candidates to opportunities and employers to professionals around the world, our services are intended to facilitate the recruitment process for both employers and workers, especially when it comes to assigning qualified professionals to key positions. By creating a user account, the user accepts that it applies exclusively to the Contractual Terms and Conditions for Companies (hereinafter referred to as TCCE).
2.General Provisions
These TCCE apply to all services offered by Mirantes to users (companies) of its platform. These TCCE apply exclusively to companies. Mirantes expressly reserves the right to make changes to these TCCE.
3. Object of the Contract and Scope
Mirantes' main obligation is to provide the platform. The data provided by the user (company) is used to improve your experience, present the most suitable content for you, as well as to optimize the weighting of selection criteria, in order to be able to suggest the profile of candidates that best suit your needs. Mirantes reserves the right to update the platform at any time and to add or remove features during this update, as well as to modify it in whole or in part. Mirantes strives to ensure that the platform can be used as much as possible. Mirantes does not verify the completeness, accuracy or legality of third party content and, therefore, does not assume any responsibility or guarantee regarding the completeness, accuracy, legality and timeliness of third party content. geral@mirantes.io to notify Mirantes of content or job advertisements that appear to violate the legal provisions or terms of use of the platform.
4. Open a User account
It is necessary for the company to register on the platform so that it can have access to the profile of professionals who are on the platform and who best suit the vacancies created by it. To open an account, the user must provide correct personal data, which can be verified. In these cases, we reserve the right to extraordinarily terminate the user contract. The user confirms that the contact details and other information requested by Mirantes during registration are complete and correct and is responsible for keeping them updated. The use of pseudonyms, abbreviations and artist names is not permitted.
5. Use of the Platform and Prohibited Activities.
Mirantes offers users the opportunity to create a profile, allowing better management of human capital, conducting the entire recruitment process, directly contacting professionals registered on the platform, launching vacancies. The user is responsible for any content they publish and is obliged to respect all current laws and other legal provisions, as well as the provisions of these TCCE, when posting vacancies on the platform. In particular, the user is prohibited from publishing any data or content, such as texts, images, logos, etc., that violate current legislation, intellectual property rights, copyright or other rights of third parties. If there is a reasonable suspicion of breach of contract or illegal activity, Mirantes has the right to verify the user's activities and, if necessary, to take appropriate legal action without prior notice. In the event of a culpable breach of the above-mentioned obligations, the user is obliged to compensate Mirantes immediately upon first request for all resulting third-party claims.
6. Rights of Use
The user agrees that they will only place data and content on the platform if they have the necessary authorization to do so and to publish them. By publishing data or content, the user grants Mirantes a free, transferable, regionally and temporally unlimited right of use to fulfill Mirantes' contractual obligations towards users or to fulfill Mirantes' legal obligations towards the respective content, in particular Whenever the user deletes the published content or exercises their right of deletion under the terms of article 28 of Law no. 22/11 of 17 June - Data Protection Law, the right of use granted to Mirantes referred to above However, Mirantes has a period of 60 (sixty) days to delete the data.
7. Duration and Termination
The platform usage contract begins upon completion of registration. The user has the right to terminate the usage contract at any time, without prior notice, by simply closing the account through the platform or requesting the closure of the user account by sending Mirantes an email to geral@ Mirantes has the right to terminate the user contract at any time, in writing (e-mail), with a notice period of 2 (two) weeks. The right to termination for just cause remains unchanged.
8. Responsibility
Unless otherwise provided in these TCCE, Mirantes is responsible, within the scope of the use of the platform, in accordance with the following provisions. If the user suffers damages as a result of the use of the platform provided free of charge, Mirantes will only be responsible if the damages occurred despite the contractual use, if the user did not act negligently and only in case of intent (including fraudulent intent) and The following provisions apply to liability for paid content: Mirantes has unlimited liability for damages caused intentionally or through gross negligence by Mirantes or its legal representatives, employees or indirect agents. Mirantes is not responsible in cases of slightly negligent breach of insignificant contractual obligations. The above limitation of liability does not apply in the event of fraudulent intent, in the event of bodily or personal injury, for breach of warranties or for claims arising from product liability. The user is solely responsible for failure to comply with their obligations, in particular for violations of trademarks, copyrights and name rights of third parties.
9. Data Protection
Mirantes Technologies - Prestação de Serviços, Lda., is aware, attentive and constantly analyzing and improving the measures implemented to protect your personal data against unauthorized access, accidental loss, disclosure or destruction. To prevent loss, disclosure, unauthorized use or access and to ensure appropriate use of your information, we implement appropriate and reasonable physical, technical and administrative security measures to safeguard your personal data. We maintain data as required or permitted by Law. When and whenever we collect, transfer or store sensitive information we use a variety of additional security technologies and procedures to help protect your personal data from unauthorized access, use or disclosure.
10. Applicable Law and Venue
Exclusively Angolan law applies. These Terms and Conditions for Companies are regulated by applicable Angolan legislation, and by the Service Provision Agreement, which for all purposes is considered an integral part thereof. Disputes that may result from these, after all possibilities of extrajudicial resolution have been exhausted, will be resolved by the Luanda District Court to the express exclusion of any other.
